You are better off with an image consultant who will admit to you that they can help you choose good colors based on what has tested well for your profession or for the social situations you will be invited to.

THE FOOTWEAR QUESTION

Our third tip for picking a good image consultant is to ask him what he thinks is more important in footwear, the look or the comfort level. How to Read the Software Consulting Contract

Confidentiality
Language regarding the handling of information which is confidential to your business is also vital to include in your contract. This language should be written so as to incorporate your data as well as your processes.

Limitation of Liability
Most software consulting vendors will not warrantee any and all damages to you and/or your customers who are using the custom solution that the vendor is developing for you. It’s important that you understand the limits of such liabilities and that you are comfortable with them before engaging the vendor.

It is also common practice to limit the contractual liability to “the value of the delivered services or $X, whichever is greater”, so that there is a limit to the financial impact of a failed project.

Billing and Payment Terms
It is a good idea to establish expectations for both billing and payment as well. Some important questions regarding billing and payment terms to consider include: Will purchase orders be issued or required? How often will bills be issued? In what format and where will invoices be sent? How soon must they be paid? What forms of payment are acceptable? Are there any discounts for prompt payment? Are there any penalties for late payments?

These terms should be set forth in the contract so that expectations are established from the beginning of the relationship and there are no surprises.

BEFORE You Feng Shui – Things you MUST know before a Feng Shui Consultation

Feng Shui is a Healing art. It is meant to inspire, transform, help and assist out clients to achieve their goals. I don’t believe it was ever intended to instill fear, make people uncomfortable in their own homes or worry about changes they make. And yet, that is exactly what I have been seeing lately.

A case in point: On a recent visit to a client I was dismayed to enter a beautiful condo unit and find complete and utter lack of attention to the home. By lack of attention, it had clearly not been cleaned in a very long time as the grime was built up on everything; the entire unit was cluttered with things lining both the furniture and couches. The kitchen went unused and it was almost impossible to step into the bedroom due to the clothes and debris all over the floor. Something had gone horribly wrong and we cleared off a space on the floor to sit and discuss her life and issues.

She was an intelligent, beautiful accomplished person who had previously been both a model and a singer in a band and was now on disability due to a recent accident. She told me that several years ago she still hadn’t found the right partner and had called a Feng Shui consultant for some help and advice on her relationship issues. The consultant pointed out problem after problem with the layout of her home, with her bathroom, with the direction of the front door—-the list goes on. In short, she was told by the consultant to move, that this previously lovely condo would never support her nor would she ever have good luck while she lived there.

Flash forward to today and my visit. She had given up she said; what was the point? She did not have the money to move and truly believed there was nothing she could do to help enhance her life. Powerful and absolutely devastating words from someone she went to for advice and inspiration. Now her mindset was and had been misery. She no longer had friends over, certainly had not even opened herself up to the possibility of a relationship and was having a series of misfortunate “accidents.” She had given up on her home and her life.

Trying to change her mindset after so many years was a daunting task. I showed her all the good points in her home and gave her easy, inexpensive things she could do to change the energy, starting with cleaning up and getting rid of the clutter. I addressed each room with a positive point of view and if something wasn’t “politically” Feng Shui correct, showed her simple things to change it.

Sadly, I have been seeing this more and more in my consultations. While I truly believe in the many methods to use Feng Shui, I am always mindful to do no harm. In someone’s home or in their Mind. Yet I am finding client after client who has been told their front door faced the “wrong” direction, the steps in the center of the home would mean constant health issues and everything negative while only providing their clients with expensive methods such as renovations or telling them the house will never support them at all.

I visit Real Estate offices quite frequently to speak on Feng Shui and Home Staging and honestly there hasn’t been one I have been in that wanted to work with a Feng Shui Consultant. Why? For one thing, Feng Shui Consultants never seem to find the “perfect” home for their client; sometimes it’s the numbers on the door, sometimes it a misplaced bathroom, sometimes there is a “negative” space and a complete area of the house is missing. Feng Shui consultants, I am told, point out only negative issues.

I am grateful that I attended classes in Feng Shui by such a wide spectrum of the very best teachers and mentors in the field who were able to provide me with a variety of inexpensive and easy to implement “cures” for all these problems. When we look at a space, we see it through what is called “Feng Shui Eyes” but these eyes can be positive in nature and instead, show a person or family how the home will support them and how to “fix” a missing piece, show them the positive aspects of the front door and how to look at Feng Shui through a positive perspective.

We were taught to be healers in every aspect of the word; we are often challenged ourselves with clients who are so hurt and worried about homes they have been told can’t be fixed, that will never support them that their lives have changed so dramatically in a downward spiral.

Look for a Feng Shui Consultant to inspire you, give you the positive, use the beautiful transcendental cures and blessings and simple and inexpensive methods to change your environment for a more beneficial flow of energy. Certainly, finding a consultant who has been well trained in a variety of methods and practices from a positive point of view won’t get you “stuck” in believing you need expensive renovations or that it’s time to move. They are the ones that will be able to transform, to help and heal and inspire. The positive aspects you put into your thoughts are, ultimately, what will provide you with exactly what you are seeking in every area of your life.

10 Reasons Why You Really Do Not Need to Employ an HR Consultant

If you own or manage a small or medium-sized business you no doubt feel that your knowledge of HR issues such as employment law, equality and diversity, HR policies, employment contracts etc. is very limited. This probably causes you a high level of anxiety in case you get something wrong which might have a major impact on your business.

This feeling is no doubt heightened by HR professionals who we hear regularly in the media expounding on the costs associated with such things as Employment Tribunals, and how easy they are to lose. There are also innumerable HR Consultancies on the internet all offering to provide services for you to ensure you are “fully legally compliant”, and also to “add value” by providing services that you never even knew you needed like the latest HR software, or an “HR Audit” of your company.

As an HR practitioner of over 20 years standing, and as one who currently works as an HR Consultant, let me tell you a secret. If you run your small / medium sized business reasonably well and you have no major staffing issues, then you do not need to employ an HR Consultant (usually starting around 500 per day), you do not need to “subscribe” to an expensive HR website, indeed you don’t really need to spend any significant amount of money at all on HR services! Here are the 10 reasons why:

  1. If you are competent enough to manage your business with all the complexities that entails, there is no reason why YOU can’t easily ensure you have a proper HR framework in place to support your staffing issues. You really don’t need an HR Consultant who is external to your organisation to tell you how to manage your staff.
  2. The risks of getting things wrong are massively over-hyped. HR Consultants and Employment Lawyers will fill you full of horror tales about the costs of losing an unfair dismissal claim at Employment Tribunal. The simple facts are that if you act reasonably as an employer, you are likely to spend far more on HR Consultants and lawyers trying to defend an Employment Tribunal claim than you would lose if the findings went against you! Employment Tribunals are really quite rare in the scheme of things, and if you do have a claim made against you by an employee, then if you have acted reasonably in your dealings with them you should have no fears in defending the ET yourself.
  3. HR Consultants are geared towards maximising their income rather than helping your business. This means that they will do their best to persuade you that you need to implement those products they support. A good example is HR software. Do you really need a bespoke HR System to record your employee details? An Excel spreadsheet or Access database knocked up in an afternoon might do just as well. If you do want an HR system you should shop around, there are a number of fairly cheap stand-alone systems out there which you could easily implement yourself.
  4. You do need to have proper HR policies in place to regulate how you employ your staff. However these days there is so much information on the internet you can easily find the information you need on there. If you get your information there, then there is no need to employ an HR Consultant to come in to your organisation and tell you the same things!
  5. There are some basic HR policies and procedures that you really need to have in place. These are in my view: Discipline, Grievance, Equality, Harassment / Bullying and Health & Safety. You may also want to add Induction and Training, and you will need some guidance on Maternity / Paternity leave and pay, and probably on Flexible Working. If you have a problem with sickness, then you should implement an Absence Management policy to address this. To be honest the easiest way to address all this is to produce a Staff Handbook which outlines all these policies and any other issues which you think are relevant for your particular circumstances. Our website has templates of most of the policies you will need – you can download and adapt these. We also have a full Policy Manual, and a template Staff Handbook. If what you need is not here, then you can easily Google it and you are likely to find something on the internet, or you can ask us if we have it. We do have lots of stuff which we have not yet put onto out web site. You really don’t need an HR Consultant to develop something bespoke for your organisation when so many resources already exist and can be adapted.
  6. The internet is a fantastic free resource for small / medium-sized businesses. From an HR perspective you can access all the information you could possibly need to ensure you have the necessary framework in place to support your staff.   7. When recruiting, which you may not do very often, you may feel you need professional guidance. This is not necessary. Just be sure that the advert you produce for your vacancies is not in any way biased towards or against one or more type of person. It is often a good idea to let a colleague have a look at it just to double check you have not unconsciously missed something. At interview construct a list of questions based on the skills needed for the job, basically asking for examples of what the individual has achieved in that regard in previous jobs. Ask every applicant the same questions. Interview with a colleague and guard each other against any bias or discrimination creeping into your questioning. Make careful notes of the answers and how you have concluded who is the best candidate.
  8. When dealing with staffing issues, if you have a problem with a staff member, you should manage the situation as you would with any other business problem. That is make sure you gather all the information you need, review the situation and then take appropriate action. If this relates to disciplining a member of staff, just make sure you investigate properly and then apply your agreed disciplinary procedure. Just be sure you have good notes on everything you do.
  9. If you are faced with a staffing situation which is new to you and you are not sure how to act, you should flex your network of colleagues to see if anyone you know has experience of a similar situation. You can also look on the web to see if you can get guidance there.
  10. Don’t worry about being caught out by changes to employment law.
